'Indian diplomat was given all courtesies, wasn't handcuffed'


Washington, Dec 19 (IANS): Manhattan's high profile India-born US attorney Preet Bhrara, also known as the "Sherriff of Wall Street", has defended his department's actions against an Indian diplomat sparking a diplomatic row between India and the US, insisting she was not handcuffed and was given due courtesies.

He also said the domstic help, Sangeeta Richard's family was "evacuated" from India to protect the "victim" as there were attempts to silence her and compel her to return to India.
Devyani Khobragade, India's deputy consul general in New York, who was strip-searched following her arrest on charges of visa fraud and underpaying his maid last week was accorded courtesies most other defendants wouldn't get, he said in a over 1,000 word long statement. Bharara claimed that US State Department agents arrested her discreetly last week and she wasn't handcuffed or restrained.

But he confirmed that Khobragade was "fully searched" by a female deputy marshal in private as per "standard practice" for "every defendant, rich or poor, American or not."


Otherwise, she was treated very well and was even given coffee and allowed to make phone calls in a car for two hours to arrange for child care.

"Because it was cold outside, the agents let her make those calls from their car and even brought her coffee and offered to get her food," Bharara said.

"It is true that she was fully searched by a female deputy marshal -- in a private setting -- when she was brought into the US Marshals' custody," he said.

"But this is standard practice for every defendant, rich or poor, American or not, in order to make sure that no prisoner keeps anything on his person that could harm anyone, including himself. This is in the interests of everyone's safety," Bharara added.

Expressing dismay over the focus on the treatment of the diplomat rather than on the alleged victim, Bharara asked: "Is it for US prosecutors to look the other way, ignore the law and the civil rights of victims ... or is it the responsibility of the diplomats and consular officers and their government to make sure the law is observed?"

Bharara also confirmed that the family of Khobragade's domestic help has been brought to the US as a "legal process was started in India against the victim, attempting to silence her, and attempts were made to compel her to return to India." He said, it was necessary to evacuate the victim's family from India as part of efforts "to make sure that victims, witnesses and their families are safe and secure while cases are pending."

Bharara said his office's "sole motivation in this case, as in all cases, is to uphold the rule of law, protect victims, and hold accountable anyone who breaks the law - no matter what their societal status and no matter how powerful, rich or connected they are."

Meanwhile, Dana Sussman, a lawyer for Khobragade's housekeeper, Sangeeta Richard, said the issue goes beyond a labour dispute.

"Our clients who work as domestic workers are living in the home with their employers," she told CNN. "So, if they leave, they not only leave their legal status, they leave their only source of income, they leave the only home that they've known in a foreign country."

She said Richard has no passport, is living with friends and has been granted temporary legal status that allows her to remain and work in the US until the matter is resolved.

    After reading all the mess that was created by this kabragade in India and USA, which is not expected from a person of that position that brings shame on the country, one can safely infer that the treatment meted out was wrong, but her arrest was right.

OK if that's the case if Indian government put the US bureaucrat behind the bars you will support to US saying the Indian Government treatment is bad, and that time you will not talk about the rules break by US.

    The whole affair smacks of pretension and lacks sensitivity. Granted that the Indian diplomat was wrong to under-pay her maid and make attempts to silence her. However, in the name of upholding the law of the land, the India-born attorney presumably has over-reacted, perhaps to impress the US justice system of his even-handedness. It is anybody’s guess how often the native-born US populace get away with such acts. Though the victim deserves sympathy, she is caught in a quagmire unwittingly.

    Whatever may be the case, the treatment what we have been hearing is not good. America should not think they can do anything to a citizen of any country. They should be taught a lesson by some country because their indulgence in other country's affairs is getting a bit too much. As far as Preet Bhrara is concerned, he will have this effect felt very soon.

    I have been reading all the comments supporting this Diplomat, but I am sad to express that nobody has spoken about the victim here.....! Because she is not famous, she does not have a popular position like this diplomat, we Indians shouldn't forget that this poor victim is an Indian too. Nobody knows what torture she has been through when she was working with this sneaky diplomat. I am sure that will come out too.
    What US has done is absolutely right. There is no different door for poor and rich people. In The US everybody is equal. In India rich criminals get special treatment, that doesn't work in the US.
    I have been living in the US for many years and I know how things work in this country.
    Please try to show your support to this poor victim too.

    Dear Sonal..You didn't understand the issue properly.We and Govt of India are not happy with the way Indian diplomat was treated.She was treated absolutely like a Terrorist or notorious drug dealer.There is a Diplomatic way in handling Diplomat people..Because they are representative of our country..We and Govt of India would not have raised questions if US had strip searched Devyani for carrying arms,bombs with her..Hope,you understood now..

    Dear Sonal, understand the scenario of the maid as well. She has gone missing since June and India had filed a complaint with the NYPD. And 2 days after her family moves to US, she surfaces and the diplomat is arrested. And if you do not know, the maid's father works at the US Embassy in India. Read the case file that India has accused the US of Immigration Fraud. And what country brings the relatives of the plaintiff to ensure their family is safe for legal proceedings to be smooth? Does US brings family members of other expats staying in US when their case is going on in the court. This is pure bulls**t by the US...
