Supreme Court gives voters right to reject all candidates

New Delhi, Sep 27 (IANS): In a significant verdict, the Supreme Court Friday said that for a vibrant democracy the voter has the right to negative voting by rejecting all the candidates in fray by exercising the option of None of the Above (NOTA) in EVMs and ballot papers.

The apex court bench of Chief Justice P.Sathasivam, Justice Ranjana Prakash Desai and Justice Ranjan Gogoi said that negative voting would gradually lead to systemic changes as political parties will have to respect the will of the people in selecting their candidates.

Pronouncing the judgment, Chief Justice Sathasivam said the mechanism of negative voting is necessary and vibrant part of democracy.

The court directed the election commission to introduce a button providing for NOTA in the EVMs and also in trhe ballot papers.

It asked the central government to provide all assistance to the election commission in introducing NOTA option in the EVMs and ballot papers.

The People's Union for Civil Liberties (PUCL) had moved the apex court in 2004 with a plea that voters should have a right to negative vote, saying that it does not want to vote any of the candidates listed in EVM.

It had sought directions to Election Commission (EC) to make provision in the EVMs providing option "None of the Above" and the right to say NOTA should be kept secret.

The apex court bench of Justice B.N.Agrawal (since retired) and Justice G.S.Singhvi by their Feb 23, 2009 judgment while referring the matter to a larger bench had framed two questions for the court to examine "whether the right of voter to exercise his choice for the candidate is a necessary concomitant of the voter's freedom of expression guaranteed under Article 19(1)(a) of the Constitution".

The court on the second aspect had said, "We are further of the view that width and amplitude of the power of the (Election) Commission under Article 324 needs further consideration by a larger Bench in the light of the (earlier) judgments of this court whereby the elector's right to be informed about the assets and antecedents of the persons seeking election to the legislature has been duly recognized".

    Though it is a historic judgement, recent polling data has shown that maximum voting is done by those from lower strata of society and some from middle class, the rich mostly avoid in such a scenario, most of the poor/illiterate masses of voters can still be easily influenced!!!

    Few in this forum concerned about 50 percent. Forget about 50 percent even if it touches to 5 percent. All parties will do their best to field best candidate to gain that 5 percent. And all our parties are good in that calculations. So, think and vote for NOTA*

    Well the judgment in letter and spirit looks great. However I am still in the dark on the operative mechanism of this seemingly “Landmark Judgment”. I would appreciate if someone in this forum would shed further light and put to rest my apprehensions and hopefully many others who are like minded on this subject. Take this hypothetical case of a constituency, where the number of NOTA votes (80%) far exceeds those cast in favour(20%). So can I infer from this judgment that the candidate getting the highest votes from the 20% (against the back of 80% who consider the candidates unworthy) will represent the constituency in the parliament. Please help me to better interpret this judgment. One especially needs to be careful and not over excited with such a judgment, especially because of the high degree of illiteracy in India and vote bank politics.

    Imagine in India we have simple and un-suspicious poor casting ballots for one candidate or another just because they promise them rice at Rs 2 per kilo, pressure cookers, TV sets and the like. It's exactly like the food bill or the pay commission bill, the timing of such bills only serves vested interests. Do you think the govt. over the last several decades was not aware that many people were going to bed with empty stomachs or that govt servants were being underpaid vis-a-vis high inflation. These are surely tools by any ruling party just before elections to hoodwink the less fortunate.

    Practices like this should also be struck down by the Supreme Court. I think the Supreme Court needs to put things in perspective and remedy the political electoral system from systemic flaws to the extent conceivable before groping aimlessly. It is as though always the “cart is being tied before the horse. The system can be revamped only if the rules and ethics governing the road to elections are looked at by the supreme Court in totality and changes made through a “Maha Supreme Court Binding Order”……even now it is not too late to protect our democracy run by thugs. So why doesn’t someone move the court. Ordinances are not the right of any Parliament but should be ordained by the People.

    NOTA option virtually existing for most of electorates.They are already practising it by not going to vote for undeserving candidates,Need of the hour is to bring in new policy for right to recall non-active elected representatives ,most of elected candidates never go back to their Constitiencies to take of the development work.Most recently Navjot Sigh Sidhu visited his constitiency(Amruthsar) after gap of 2 Yrs.

    What is the outcome of this ? there must be percentage system for NOTA ,for ex: if NOTA is crossed the 70% and above then those who stand for election must disqualify and not to be given chance for contesting election for life time, re election must happen in the constituency other wise this will be a bakwas .

    It is a powerful weapon in the hands of voters, which can create an adverse situation in the country.
    Being most of the population is suffering from the worsening economic situation and by considering the level of corruption, if majority of voters press with pressure, the none of above button, then the huge amount being spent on polls will vanish and it is likely to press the button for re-election, which will be a severe problem and add oil to the burning situation.

    This judgement has a drawback. If more and more people who consciously decide to press None of the Above in EVMs, then very few voters wil be pressin for candidates. The criminal background politician can Manipulate his vote-bank to win elections. More the number of voters who dont opt for a candidate, the easier it is for a crooked politician to win. Crook politician just have to manipulate small number of voters to win.

    Please don't forget, each citizen has One Vote only. By pressing NOTA, he will not be able to Vote for any other Candidates. That means, the one who exercise NOTA can not Build Vote bank for other Candidate.
    Yes further the EC needs to look in to the technicalities to address the concern you have raised. Lets hope EC will do their best. There can be many options, including declaring particular consistency under President rule, if NOTA increase certain ratio of Positive Votes cast. This is just the start.
    This is as good as going to Vegetable market, with right to return, with out buying, so that the Vendors, slowly start bringing fresh vegetables, we wish to have.

    2 landmark observations by the Supreme Court, one on the criminals in politics and now the negative vote right. It looks that there is going to be a war between the politicians and the judiciary soon. The politicians will put all their weight to negate this observation by the Supreme Court. What a state we are heading to, that the Supreme Court has to force itself to cleanse the system, instead of the politicians doing it as the basic duty towards the country.

    In one of live-interaction, Justice Santhosh Hegde was asked about how to elect a deserving candidate. His solution is worth noting. he opined that at present the voting percentage is very low. Many of us do not cast our votes, especially the educated n youth. Majority of constituencies report very low voting below 40percent, many of them are uneducated, old men n women. This makes easy for criminal politicians to manipulate the outcome. They bribe these voters at last moment and buy votes. Lower the number of voters, less is the money spent to buy votes from innocents. If a criminal background politician is able to influence 15 percent of voters in his favour by way of giving money, liquor n gifts, then his victory is assured.

    To stop this, if number of voter turnout is more than 90 percent, then these criminal politicians have to spend huge money to buy more than 40percent of voters. More number of voters will make life of criminal politicians tough.

    Justice Hegde suggesated that make everyone to vote and this will surely result in deserving candidate and less of dirty tricks.

    Supreme Court's judgement again places importance on political parties ing their candidates. I still worry about political parties. Do we need a political party in a democracy ? Why such emphasis placed on political parties who act as if they are supreme n all-powerful ? Political parties have become corporate companies, they act in autocratic way, their main agenda is to generate revenue, and a political party goes to any cheap levels to grab public office.

    Question still remains - Is there an alternative ? Can we get rid of political parties which do not reveal any information about their source of funding? Their internal democracy is shrouded in secrecy. Aaam Aadmi Party is one credible experiment in Indian Polity where they reveal their source of funding along with names, and other important information is shared in public domain. Can other parties too practice some transparency and play a game in level-playing field ? India politics needs to be evolved in right direction for national good. Many more experiments in politics like AAP are welcome.

    This is a landmark judgement, Chief Justice P. Satashivam, please accept my hearty congratulations. Indian citizens are awaiting many more such landmark judgements.
    I hope election commission would be in a position to implement this SC order with immediate effect. Now all the political parties will think twice before ing their candidates, otherwise NOTA will be the winner in many constituencies. Then there will be a re-election with new candidates. Indians would have been happier if SC barred the rejected candidates from contesting in any election for next 10 years.

    Landmark Judgment. Advantage, it is the citizens who will have the final voice, VETO power by pressing the panic button saying that none of the candidates is worthy of his vote. Awesome !! People’s Judgment could be a whip for those who used to play with voters sentiments.

    1. If negative voting is greater, fresh elections must be held very often causing
    regular chaos waste of money and time.

    2. As usual, Politicians might play dirty tricks to counter it by bringing an ordinance

    It is pertinent to note that in the face of all administrative machinery collapsing the judiciary has taken it upon itself to bring some sort of a sanity in the happenings in our country. The politicians are , however, trying their level best to scuttle every attempt of the Hon'ble SC. Days are not far off, if allowed to continue this way, there will be utter chaos and lawlessness in this country. Some sort of a change is a must, a plan devoid of politicians, for starters.     Anna Hazare gave call for ‘Right to Reject’. AND Gujarat government had passed the bill for this cause twice in 2008 and in 2009, but sadly Governor rejected it.

    NOW ASK Yourself, Who is Against the Voice of India and Who is For the Voice of India.

    Now Every Indian can express their opinion on the candidates contesting in election by NOTA.
    Many do not opt for voting as they opine there is no one whom they like to vote. Because of this attitude many unfit people come to power. If every such voter, votes and expresses themself by NOTA the results will be fair.
    This should be further strengthened by barring such cadidates from further contesting in election for a specific time.

    The value of thier vote - not a saree or 1000 rupees or a bicycle or a bottle. but 5 years of a vibrant growing India.

    This will not serve any purpose unless such negative votes are deducted from positive votes.
    Only when the Voting is made mandatory for all Voters and not voting attracts penalty, only then this rule may be of use to individual voters to prove that he has not abstained from voting and he is not liable to pay any penalty.

    Though this is a landmark judgement and credit should go to SC and Anna but this law will not add much value. As per the judgment, if more than 50 per cent of those who vote reject all candidates, then only there will be a re-election in that constituency. This is unlikely to happen, because in our divided society majority of the people vote for religion, caste, party, a bottle of booze, personal relations and not for candidate....therefore we have seen so many criminals in the legislative assemblies and parliament. SC's earlier Judgment on convicted politicians is far more practical and stronger.

    What is the use of SC verdict and who cares....Whether govt is expected to honour the SC verdict.When SAC gave its verdict against the candidates who are convicted in criminal cases making them ineligible to contest elections govt brought an ordinance setting aside SC verdict.Same trend will follow here also.Country has severe shortage of good candidates to contest elections........
    In SC should direct the govt to give election voter identity all citizens and make voting compulsary.
