Reliable sources said that advocate, B V Acharya, who has been representing Bayari in the high court, filed an application withdrawing the bail petition moved by his client. At present, Bayari is in judicial custody.
Another accused, Subrahmanya Udupa, had some time back, been granted conditional bail by high court judge, Justice Sridhar Rao. This was questioned in Supreme Court through a writ petition. In the meantime, Justice Sridhar Rao had rejected the bail petition moved on behalf of Bayari once.
The present bail petition was moved before Justice B V Pinto, who presided over the vacation bench of the high court, about two weeks back. It is said that the judge asked the petition to be transferred to the bench headed by Justice Sridhar Rao, as the case is being handled by that bench.
During the course of examining the bail petition, the judge referred to various aspects relating to the case like writ petition filed against conditional bail granted to Udupa, moving of the bail petition directly in the high court instead of lower court, and some other points. In this background, advocate representing Bayari withdrew the bail petition of his client on Friday, it is learnt.
