Delhi gang-rape: Sixth accused is a minor, may walk free in 5 months


New Delhi, Jan 28 (PTI): The sixth accused in the case of December 16 gang-rape and murder of a 23-year-old paramedical student here was today declared by the Juvenile Justice Board (JJB) as a "minor", which would enable him to walk free by June 4, this year when he attains the age of 18 years.

The accused, who was described as the most brutal of the six accused by the Delhi Police in its charge sheet, was declared as 17 years and six months and 24 days-old (as of today) by the JJB, which relied on his birth certificate and school documents produced before it.

Section 15 (g) of the Juvenile Justice (Care and Protection of Children) Act mandates that a juvenile aged between 16-18 years if convicted of any offence can be sentenced to be sent to a special home for a period of three years at the maximum, and, thereafter, be released on probation.

However, section 16 of the Act also provides that a juvenile can only be kept at the special home till he attains 18 years of age and he cannot be sent to jail thereafter, which in effect will result in his release.

The JJB also rejected the police's plea for bone ossification test of the sixth accused for determining his age. Lawyers appearing for the prosecution said they appeal against the JJB order in a higher court.

Earlier on January 15, the principal of the school, from where the juvenile had dropped out, had submitted before the JJB that as per the school records he is 17 years and six months-old.

    Sir there is more than what meets the eye here. The key point is that the so called juvenile is 'secular' and hence he cannot be accused of any crime. The media is deliberately using misleading pseudo names like 'raju' you can find out what his real name is. The Govt was not ready to accept school records of Gen VK Singh regarding his DOB but is eager to accept this barbarian's school records. Why??

    It is true that as said by ex-judge, the law cannot be changed for one horific incident. But it can be and should be ammended implimenting strict punishment (Death penelty) for rape cases. Or else in future you will see more rape cases in schools and colleges because escape is easy.

    As per the present law this juvenile may be set free when he attains 18 yrs and few months under observation.
    This may well encourage some deeply heart relatives of the victim or neibhours who themselves are juveniles to take action which
    judiciary could not. Is that make sense.

    I do not understand how this works. When he committed the crime, he did it in an adult fashion and punishment is meted out to him in juvenile state. Well, this decision of the court will give room for more such crimes to be committed against girls / ladies by adults and get acquitted as juvenile. You are going to release a mentally distorted person into the society. If care is not taken to punish him now as an adult, there are cent per cent chances that this animal will commit similar crimes in future too. This happens only in India. Other western countries, once the juvenile attains the age, he would be either tried as a major and sent to prison or would be under social security cell, who monitors his behavior and makes him work for the family who has suffered due to his crime. This is sickening. What can be hoped from a judiciery system, which still follows the archiac system of meting out punishment and does not consider the present conditions or circumstances.

    This is an another example for our archaic judicial laws. Is that make any sense to let loose a criminal for simple reason that he is a minor and that too while just few months away by attaining Major. This case should be handled by Jury instead of Juvenile Justice Board. If this case is not handled properly, this will be an open invitation and encouragement not only to Juvenile but to criminals and extremist to recruit Juvenile for their nefarious activities.

    Please Please make this case as a bench mark. For Gods sake treat the offender based on his crime rather than his age. If he's freed in 5 months, you'll have many more rapes and sexual harrasments in this age group, especially there are young girls and women in this age group who are exposed and come in close contact to these so called juvenilles. For rapes there should'nt be minor and major and in this particular case the minor is the most aggressive so please treat the law on its merit rather than the old Indian system of quotas and reservation which has brought this country to its knees.

    Yes, agree the laws are complicated and probably not strict enough. But I don't entirely think it is the weaker law that is provoking these wrong doings. I think the problem also lies in the environment in which we grow up,that has significant influence in shaping one's character. I think the parents, schools and colleges will have to take up greater responsibility to provide social education to the kids. Because we all know, most of the things we learn in our childhood will be with us till our life time.

    @ kavitha bolar , mangalore. Its not strictly binding that INDIA should follow the UN rules on the defination of child. All countries do not follow it , and have their own specific laws , speciallly when it comes to age of consent for relationships. Eg: Age of majority in most of europian countries comes before 18 , specially in mulims countries age for relationships starts at 12 and even 9 ( iran ). I feel age of juveniles in india should atleast be brought down to 14. Remember AJMAL KASAB could have walk free , if he was just 2 years younger , when he has caught. Time to amend laws ......

    I am regretting that my prediction became true..Notorious Rapist can walk free after 5 months..! What a shame ! At the most he can be kept in special home and not in jail for 3 years.This bast..d is the one who put iron rod into victim's vegina and damaged her intestine.According to TOI,doctors found some metal powder/piece in victim's intestine.
    My humble request to our PM,please change this ONAKE OBAVVANA kaalada rules.Hope police will remove black cloth from accused face next time.Now no one have good idea about rapists.

    This boy should be given maximum sentence possible. He is well aware of the crime and he bloody well knows that he is not playing with a doll. Knowingly he has raped the girl. The court must annouce severe punishment and we don't need any drama by the lawyers concerned.
