New Delhi, Jul 26 (IANS): A Delhi court has paved the way for the trial of nine people, including a former registrar of cooperative societies (RCS), after framing charges against them for allegedly creating a fake society to obtain pecuniary gain.
CBI Special Judge Vinod Kumar Wednesday framed charges against nine people for the offence of cheating, forgery and fraud and under various sections of the Prevention of Corruption Act.
According to the prosecution case, Shri Narayan CGHS (Co-operative Group Housing Societies) Ltd was registered with the RCS and put under liquidation vide order dated Dec 26, 1978, as the society's members were not interested in its continuation.
The accused, Vishwanath Aggarwal, claiming to be the society's secretary, requested for the revival of the society in September 2003.
Investigations revealed that another accused, Ramesh Chandra, then assistant registrar (east), appointed Faiz Mohammad as inspecting officer, who submitted his report dated Oct 27, 2007, saying he had visited the society's office and inspected all the records available with Aggarwal.
It was found that Narayan Diwakar, the then RCS, and B.S. Aswal working as an election officer cleared the revival of the society.
"Investigations disclosed that Aggarwal fraudulently enrolled 65 new members and that he and Sri Chand in connivance with RCS and his colleagues managed to take over the society and got it revived on the basis of false/forged documents and false report submitted by Mohammad," said the CBI.
The prosecution had told court that there was no evidence of getting pecuniary benefit by the accused for themselves but it was clear from the record that the acts of the accused were an attempt towards obtaining pecuniary advantage to the builder mafia, who would have earned huge illegal profits in case the land were allotted to them.
The court has also found prima facie evidence against the other accused, Mohan Lal, Prahlad Kumar Thirwani and Balam Singh Aswal.
The court has fixed Nov 5 as the date for the examination of prosecution evidence.
