People-friendly Police - A Distant Dream?

Mangalore, Mar 1: Despite the valiant efforts of the police department to project their policemen as people-friendly and trustworthy, there seems to be no let up in their behavior towards the public. While the recent incident of raid on 'Moon Shine' beauty parlour in Mangalore has amply demonstrated the disgusting and cavalier level to which the policemen can stoop to, which has only resulted in their suspension, the following incident (though of not of the magnitude of Moon Shine incident) is an example of how insensitive and unkind some policemen can become especially in adverse situations like the labour strike of February 28, 2012 that had paralyzed normal life all over the country including Mangalore.

On the evening of the strike day and traffic jeep was stationed at Nanthoor and the policemen headed by Sub Inspector Sanjeev Naik of Kadri Police station was stopping many vehicles especially two-wheelers and four wheelers as other forms of transport for paralyzed, for checking of documents including pollution certificates. Passing on the Nanthoor one could see hapless two-wheelers and four-wheelers trying desperately to gather documents from their vehicles, as it was getting late to reach their destination.

The sight of one two-wheeler rider who was pleading with this S I was indeed quite pathetic and that is what arrested my attention. While this rider, a daily wage labourer was heading towards his home to Ekkur he was stopped by the Sub Inspector and asked to produce documents. The rider had all documents to show except the pollution certificate, which he said he had left home (which may or may not be true). He said he would bring the certificate and show him but the police were not ready to let him go with his vehicle. The S I asked him to pay Rs 500 fine and threatened to seize his two-wheeler which really perturbed the man as he did not have the money to pay the fine and seizing the vehicle would mean he would be stranded or will have to walk all the way home as there was no auto or bus.

While this man went on pleading, the SI was mouthing platitude on other vehicle owners with his subordinates in the bazaar language, especially on those who were trying to reason it with him. While this poor labourer went on beseeching that he had only Rs 80 and that he would pay the fine the next day the S I was adamantine, and left with no other alternative the poor man finally telephoned some of his acquaintances who brought the money (the S I had reduced it to Rs 300) and left the spot with a big sigh of relief. The SI  and his team issued him a receipt for the money paid.

It has to be agreed that offenders need to be punished so that they don’t take it for granted. No doubt the SI was diligent and was going about his job with sincerity and one has to commend him for doing it. However, one may be obliged to ask whether SI Sanjeeva Naik and his team should have displayed their sarkari duty on a day when strike had affected normal life. Don’t these men in khaki have to show their benign nature depending on the situation? One may be tempted to ask whether the SI would have acted likewise if it was his relative or family member. Could he not show the man the consideration of paying the fine the next day rather than threatening him of seizing his vehicle? While vehicle offenders are often asked to pay fine with a slip pasted on their parked vehicles, why this new rule to pay fine then and there?

It would no doubt be wrong to dub the entire police force as being corrupt, merciless, raunchy, wicked and scapegrace. After all we have to agree that the police are also the product of the society. But the number of those who are sincere and humane is quite marginal and in the face of the flagrant majority it gets masked. Incidents of this nature are surely a big blotch on the entire police force. It is not enough if the police are just asked to be considerate and more humane. What about taking some classes against the erring police in not punitive action?

    Let it be clarified, if the person not possessing pollution certificate can produce it after getting such certificate with in 7 days and mere non production on demand is no offence. Legal alumni can high light this.

    The Police man / Inspector are doing their duty . It is the vehicle owner/ driver's responsibility to carry all documents. The PUC is compulsory .Most of the vehicle owners/ drivers are acting over smart. So don't crtisize simplely policeman . Don't say poor two wheeler. If he havinh vehicle he is not poorman . He has to oblige the law.

    Police could have been confiscated the licence and let the user go.Lack of training are the main reason for these kind of scene.Police should carry out their duty in a flexible as well as rigid manner depending on the situation.Punishment is very much needed to correct the mistakes but with the right option it may help to solve many problems.

    America. They can get some first
    hand lessons about police approach
    with the public in traffic violations. After getting a few
    weeks of practical lessons. They
    must take classes for their subordinates in India and teach them, how to
    behave to the public.

    Even though we got freedom from
    Britain more than 6 decades back,
    still the Indian Police is under
    the British dominion.

    All the reports should shown in one Vehicle Registation Card. How can we carry so many documents along with?
    Secondly, is it a offence, if you are not acrrying all the documents? If there is a fine decided by government how can a Inspector negotiate on it? who gives the right to negotiate?

    We elected some one during the elections can he look into it?. Or he is busy watching Movies and sorting our the after effects?

    next time when you are stopped ask him to show the rule in motor vehicle act regarding insurance or PUC.Sp need to train his men more people friendly and teach them to smile.most of them look so arrogant from their outlooks.i pity their home members.

    As per law cops can issue a challan and you can produce the insurance in 7 days and pollution certificate in 3 days.sad thing many are not aware of the rules thats why cops take advantage of the situation.Mangalore cops are one of the most corrupt even when he is off duty he will stand on road to collect little ill gotten wealth to make his wife happy.cops cant ask you to leave ur vehicle on the road he can note down the no.and issue an notice.

    U R absolutely right like in the UAE they only give you notices and take your license or car RC and give it back after u clear ur fines there is also an additional fine if you delay beyond a month

    Police take advantage of innocent people, According to the law Police cannot seize the bike they cannot even ask him to pay fine on the spot, they can only issue notice and ask them to pay the fine with in 24hrs.

    Why cant paying traffic fines happen at bank counters or post offices, then take the receipt and go to police station and taken the driving license back. The Police men or RTO for any reason should not be allowed to take any money on the spot.

    ONE QUESTION TO SI MR.NAIK HOW MANY SUCH TWO WHEELERS HE FINE ON OTHER DAYS ! IT WILL BE A BIG ZERO BECAUSE ON OTHER DAYS HE WILL BE BUSY IN MAKING POCKET MONEY THRU FOUR WHEELERS. DUE TO STRIKE BEING DULL HE HAS TAKE DAILY INCOME TO HOME AT ANY COST OTHERWISE HE WILL NOT BE ALLOWED GETIN. POOR FELLOW !

    In Gulf counties even the accused with serious crime will be treated well and take their statement in a gentleman way. I remember an incident in Dubai, where I was driving towards the main road and from the parallel side-road next to the main road, a taxi appeared suddenly in front of my car and I had no option but banged the taxi. The police greeted us very friendly and they found from the sign boards around that the taxi should have Stopped & Approached hence the taxi driver was made to repair his as well as my car.
    The police come, take the license of both the party. Next take the statement with a drawing & the RTO Sign Board locations. Then they show us the complaint along with the drawing and make us sign on those statement sheets & the drawing. Later, in the police stn the higher authority study the case and acts according to their law in a very fair manner. After settlement of the dispute & total satisfaction, the police give back the licenses.
    That is called true justice.
    In India, the police will act with high handedness, terrorise the accused & the victim with huge penalty. Finally the accused succumb to the pressure, pay huge bribe & a small fine. What else the common-man could do under the merciless & corrupt police trap?
    There should be CCTV all over the police stn & the NGOs should check how cleverly they siphon money through a systematic method from low rung constable to the writer to the inspector in a much planned manner. How to stop such organised corruption by the law protector & the Govt servant? Can’t we the common-man, find a way out from such police tortures for a minor violation of RTO or other laws?

    Let that Bikeman produce the Receipt issued by the said S.I. to the court of law and find out whether that receipt is genuine one or not and also tune of fine imposed on him for the particular legal error/ mistake/ offense. Let him spend a little money on a good lawyer for this reason.

    Here is a latest news in the TOI relating to the subject that KHAKI TERROR-A senior citizen deied after he was allegedly pushed and kicked by two Police Constables @ Daula Kuan Police Station South Delhi.The retired Accountant suffered heart attack and collapsed trying to save his being beaten up police constables.This news adds further debate on said issue of DAIJIWORLD.

    Police enforced for keeping the law and order .It will be their duty to find the offenders , then fine them or refer to the court of law.

    The first option looks easier for them since they can finish off the matter on the spot with little bargain. but the second wont be so easy . They have to be present in court whenever they have been called for crossing.

    Coming back to the point of spot fining .Do any of the higher officials clarify the genuineness of the receipt book the officials are having to collect fine on the roads. Are these books accountable or audit able ? Who is the person in charge of such collections ?

    I hope and wish it is not reaching till top in Bangalore.

    The SI is showing his power the public should make sure that he is a servant of their's by who's Tax money he is being paid. Poor people have no time to deal with all these things. Every one should book cases against these officer's for haressing. To pay the fine there must be a separate dept not police dept, post office is having no much work now so they can collect the fines. If the rider was even a distant relative of a politician the SI would have let him go off.

    I can tell that it's only ones fate. One day the SI will also be in a similar situation and will repent his act that day. What is the big deal in not having a piece of document terrorist's and naxalites are roaming freely no one to catch them, what a shame I do not understand how these people go to bed at the end of the day after all these Good deed's of the day.

    Police in India is the worst in the entire world. They think that they do anything and get away with it. They are are known for use of 'unparliamentary' language. In Mangalore they also act as paid goons to intimidate or threaten people for their masters illegal. A simple example is - One of my relatives paid money to the police and without registering a complaint he called me to the police station. This is happening with many people in Mangalore and police by taking money from few indulge in illegal activities.

    SI might have thought to have small amount without receipt, as it happens in Mumbai Airport with Custom Officers. Kadri Police station is on head line nowadays for wrong issues.

    I hate police personnel(not all) for their rogue,police language and unsympathetic behavior towards public.However,I come across Sub inspector of Police of VENUR Police station,Mr Umesh Uppalige,an civilized,honest and people friendly officer which might be rare in Police department.SI Sanjeev Naik can be avoided levying
    hefty fine for poor hapless two wheeler but KHAKI always enjoying in Harassing public.

    Confiscation of vehicle other than for criminal activity needs courts order. Police can impound the documents like license, RC, insurance vehicle and issue him a receipt and let the vehicle go... Next day the owner can go to the police station pay the fine or bribe and collect the document. Its very simple... But here the SI was an animal and hearless person and showing his power to the ignorant citizen... Please file a case on him in the court...in the name of harrasment...
